Avoid dual agency conflicts on "in-house" listings- common when a "buyer agent" also works for the seller's listing agency *
Buyer's Edge Realty provides unparalleled levels of true buyer agency representation and protection empowering discerning homebuyers to make informed decisions on any property of interest. As Westchester's Premier Exclusive Buyer's Broker we do not list property for sale, enabling us to fully represent and protect the interests of homebuyers only- Not homesellers. Sacrificing the profitable listing side of the real estate business is the only way, by law, in which to provide the highest levels of buyer agency representation and protection on any property at all times. This greatly benefits homebuyers by eliminating the conflicts of interest and homebuying risks of 'dual agency' commonly employed by non-exclusive "buyer agents" working from ordinary sellers' listing agencies. As member Realtors we have full access to any property listed throughout the Westchester-Putnam Multiple Listing Service (MLS) or from any other source. We focus our efforts on helping our clients locate and purchase properties meeting or exceeding their needs and expectations. Like all Realtors our fee is already included in the price of any MLS-listed home.
Our expert residential Exclusive Buyers' Agents are available by appointment 7 days and evenings a week to discuss your homebuying needs and concerns. Contact us by phone or email and discover The Intelligent Way to Buy A Home.
* "Agent" and "agency" refer to a legal relationship by the entire company- Not an individual licensee.
OKLAHOMA SUPREME COURT ON DUAL AGENCY
In Snider v. Oklahoma Real Estate Commission, the Oklahoma Supreme Court's decision on June 1, 1999 stated: "Sellers' agents and dual agents do not and cannot by law give a buyer the same degree of loyalty as an agent who acts on behalf of a buyer. Sellers' agents owe their allegiance to the seller. Dual agency invites a conflict of interest. A buyer who relies on the seller's agent or on dual agency does not receive the same degree of legal protection as that afforded by an agent acting solely on behalf of the buyer".
Nowadays many real estate sellers' agents will often claim that they can be "buyers' agents", "buyers' brokers", or even "exclusive buyers' agents" or "exclusive buyers' brokers". Over 99% of agents claiming to be buyers' agents are not real buyers' agents because they work for seller agent listing companies. How can you tell if an agent is a true Exclusive Buyer's Agent (EBA) or an Exclusive Buyer's Broker? Very easily. Just ask the following question:
If they answer "Yes", they are not a true Exclusive Buyer's Agent or an Exclusive Buyer's Broker and cannot legitimately claim to be so. The use of an Exclusive Right-to-Represent Buyer's Agency Agreement does NOT turn a Non-Exclusive buyer agent from a seller's listing company into a true full-time Exclusive Buyer's Agent. This contract 'locks' a homebuyer into using only that agent and listing company for the purchase of any home, including their own company listings, creating dual agency risks and conflicts. Dual agency does not provide homebuyers with representation and protection on in-house listings while financially benefitting the listing broker/company with both the listing and selling sides of the commission- a double the money windfall! The truth is dual agency is great for the real estate company while a poor choice for homebuyers. Read our FAQ's for more on dual agency. Click the link in the answer to the second question in the FAQ's to read the legal memorandum "Be Wary of Dual Agency" by the NYS Department of State Counsel's Office warning to homebuyers.
Only an Exclusive Buyer's Brokerage company and its Exclusive Buyers' Agents provide homebuyers with undivided company loyalty, advocacy, due dillgence, and full disclosure on any property at all times while eliminating the risk of dual agency.
An informed buyer makes the most satisfying home purchase.
